U.S. Senator Roger Marshall, M.D., has called for a comprehensive audit of the National Institutes of Health (NIH) Freedom of Information Act (FOIA) practices. In a letter, Senator Marshall demands transparency in all FOIA productions by Marg Moore, NIH FOIA Compliance, dating back to 2014. The letter raises concerns about insider threats against the FOIA process at the NIH and questions why HHS counsel intervened with NIH FOIA to halt all FOIA production in May 2021.
"If the conclusion of this investigation determines that David Morens, Senior Advisor to Dr. Fauci, and Peter Daszak, the President of the corrupt EcoHealth Alliance, broke the law and obstructed a federal audit/investigation, they must immediately be referred to the Department of Justice (DOJ) for a criminal investigation," stated Senator Marshall.
The letter was addressed to Ms. Grimm and Mr. Dodaro and highlighted recent revelations about NIH and NIAID officials' behavior. It calls for an audit of all FOIA production at NIH and NIAID to ensure compliance with legal standards.
On May 28, 2024, the House of Representatives Select Subcommittee on the Coronavirus Pandemic released details suggesting a possible conspiracy within NIH and NIAID to avoid transparency related to COVID-19. Key points include:
1. David Morens allegedly warned individuals outside the government about potentially damaging FOIA productions.
2. There are claims that Margaret Moore may have assisted in destroying official federal records.
3. High-level officials at NIAID may have used personal emails for sensitive discussions regarding COVID-19 origins.
Senator Marshall expressed concern over these actions: "If true, this represents destruction of official records and must be referred to the DOJ for investigation."
The Senate Committee on Homeland Security and Government Affairs is set to hold a hearing on June 18 titled “Origins of Covid-19: An Examination of Available Evidence.” However, Senator Marshall noted that this discussion might be limited by China's lack of cooperation in providing early pandemic data.
Since November 2019, when researchers at Wuhan Institute of Virology first exhibited symptoms consistent with COVID-19, China has been accused of obstructing efforts to determine the virus's origin. Specific allegations include:
1. Refusal to hand over notebooks belonging to EcoHealth Alliance.
2. Covering up collaboration with China's military on classified research.
3. Lack of transparency regarding viruses similar to COVID-19.
Senator Marshall emphasized that American federal officials should not mislead the public or hide critical information regarding COVID-19's origins.
For these reasons, he demands an audit covering:
1. A forensic audit of all FOIA production by Margaret Moore during her tenure as NIAID’s FOIA public liaison.
2. An investigation into any other potential insider threats within NIH or NIAID's FOIA Office.
3. An assessment report on NIH and NIAID's FOIA compliance for public viewing.
The deadline for completing this audit is August 18, 2024.
