U.S. Senators Roger Marshall and Thom Tillis have introduced the Justice for Victims of Sanctuary Cities Act. The proposed legislation, supported by a group of Republican senators including Bill Cassidy, Kevin Cramer, Katie Britt, Ted Cruz, Tim Sheehy, Lindsey Graham, James Lankford, Mike Rounds, and Ted Budd, aims to address issues related to sanctuary policies.
The act seeks to provide justice for victims and their families who are affected when sanctuary jurisdictions allegedly compromise public safety. It establishes a private right of action for individuals who are victims of serious crimes such as murder or rape. This would allow them to bring legal action against states or political subdivisions that decline lawful immigration detainer requests from the Department of Homeland Security.
Furthermore, the legislation stipulates that states must waive immunity as a condition for receiving certain federal grants. The full text of the legislation is available for review.
