U.S. Senator Roger Marshall, representing Kansas, has introduced the Defining Male and Female Act of 2025. This legislation aims to establish legal definitions of male, female, and sex based on biological criteria. The bill seeks to formalize an Executive Order by President Trump titled “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.” This order asserts that sex is determined at conception, linked to reproductive cell size, and mandates federal adherence to this binary understanding.

Senator Marshall stated, "The Democrats’ radical transgender agenda is dangerous and wrong. We shouldn’t need legislation to tell us the basic reality that there are only two sexes, but here we are." He expressed gratitude for President Trump's prioritization of this issue through executive action.

The House version of the bill was introduced by U.S. Representative Mary Miller from Illinois' 15th district. Congresswoman Miller remarked, "Now more than ever, we must unite to uphold the truth and biological reality established by God that there are only two sexes."

In the Senate, Senators Bill Cassidy (Louisiana), Tim Sheehy (Montana), Cindy Hyde-Smith (Mississippi), and Pete Ricketts (Nebraska) have co-sponsored the bill. Senator Cassidy commented on the straightforward nature of biological sex: "Common sense and science tell us there are two sexes."

Senator Sheehy criticized modern terminology in gender discussions: "Boys are boys, girls are girls... Supporting this legislation is a no-brainer." Meanwhile, Senator Hyde-Smith emphasized fairness in sports and Title IX principles: "By affirming biological truth... it’s time to restore common sense once and for all."

Senator Ricketts described the bill as foundational: "This bill is simple. It defines the most basic science."
